Just to make a note here, a good percentage of IBM drives that have the 70GXP or 60GXP model names are faulty. There are known problems with the platter substance and failures of drives due to them. If you need an RMA please see the following link.
IBM Warranty guide / RMA To answer the other question, yes they are being sued, there was a class action suit, but IBM has since sold their HD business. Most drives will start to click and be undetectable until replaced. SMART monitoring is useless. Get a click, return it. IBM will require you to run the IBM drive utility and give them the code it returns, so do it before you call, and when it's clicking.
